Ok... I need to mention something here...
Over the years, Brendel has released various Blitzkrieg Add-ons with questionable Licensing Issues.
Also, because this is a Commercial product, there have been reports that many objects and models created by other authors have appeared in his releases without regard to their intellectual rights and copyrights... or permission.
For this reason, it is the intent of this forum to not show Brendel Software or Screenshots. Brendel has with purpose been left out of the Forum Add-on Sections.
So... because I have just inquired about whether he has obtained proper licensing from NIVAL to create Commercial Releases...none of his Software, Screenshots, or Links will be permitted to be shown within this forum.
In past discussion within this Forum, many felt the Licensing might have been provided by CDV or LaPlata. They cannot provide, convey or sell a License to anything that they also had to License.

There was a similar argument in the german community 2 years ago because brendel used maps from the german community without asking for permission in a commercial addon.
I also find it questionable to demand 25 € (!!!) for maps that are far below the level that we are used to from the community made maps. The new units in his addons are stolen from MK/MB or from various community mods like HeimatfronT...

What has always bothered me about this is the way he conducts business.
It does not seem to bother him to take stuff from other people, but if someone uses something from his work, he threatens them with legal recourse, even if it was something that was already public domain... and only has his skin. And if you do look at his EULA, he makes no bones about coming after you or anyone if you do violate his copyright. What I find interesting is how he claims copyright on stuff he cannot own.
From what I have been able to find out so far is he does not have any kind of Licensing Rights from NIVAL. One from CDV never existed, nor did one from La Plata. Neither of those would have been valid to cover NIVAL code or objects.
Having said that, the NIVAL EULA from 2002 is pretty clear... you can do just about anything you want with the game for your own use. You can share SOME of your work with others; models, MODS, maps, etc... as long as it is freely shared... YOU CANNOT SELL ANYTHING BASED ON NIVAL CODE, period. YOU CANNOT SELL ANYTHING CREATED FROM NIVAL CODE.
Because I have been very involved with NIVAL over the last several months on this same EULA definition, this kind of stuff does more harm to our community than anything positive. Here's a guy that is more interested in making money on someone elses stuff. That does not promote the BK Series or this Community. I'm sure he will sell some of his releases and make a few dollars. But is sure puts a bad taste in my mouth when many of you have given more time and dedication to this game than he could ever touch.
What I find very telling in this case is nowhere on those releases does the word NIVAL INTERACTIVE or their LOGO appear. Nowhere in any of the documentation is credit or copyright acknowledged to NIVAL. The closest thing stated is a Third Party may have a copyright on part of the content. On every legal Licensed product ever released I have ever seen, the NIVAL Copyright and LOGO is very much displayed and acknowledged. That in fact is a very clear part of the condition of License. That is exactly why the code I have produced is very telling... NIVAL will maintain the copyright on it. Just because I modified the code does not in any way make it mine... it is derived from NIVAL's original code and becomes part of their copyright.
My decision to have a discussion with NIVAL to make sure I did not violate the copyright with the Multiplayer Proprietary Server Interface Code was the correct course. If I had not done that, and just released the new code, and later down the road NIVAL threw a flag on it, my actions and conduct would have caused harm to this community. That single action would trump all of the good work I have done. It would not matter if I had made any money on it or not. We're talking about a legal obligation here. What is moral or not is not the issue. Although, this kind of money grab does have the stink of lack of morality... does it not?
And just to be clear... When the code (Multiplayer PATCH) is released... if you decide to open the various files, you will find in the header:

I should caution all of you of something else. In his statements and documentation, he threatens action if his site or product is mentioned by anyone for any reason. He solely reserves the right to talk about himself or his stuff. The problem with that is I never signed any kind of contract giving him that kind of power over me. Just merely reading it does not consummate a contract or its terms. But a good attorney can argue he has the right to quiet peace and harmony free from attention. But because he is out there, and now a part of the World Wide Web, he is anything but private... so his right to maintain control over the rest of us is void. It does not mean he cannot or will not try.
It should be clear to everyone what is going on here. The Blitzkrieg Title is very much alive. BK 1 is on its way back and very strong. BK3 is proof from NIVAL there is interest in the Series. The latest interest from NIVAL in BK1 and our community is more proof. So the time is right for a lot of stuff like this to find it's way back into the mainstream.
So the moral here is sometimes it is a lot harder to do the right thing and play by the rules.

** For those of you that do plan to purchase his releases, please do not post screenshots or discuss it in this forum.
** In interest of protecting the members of the community here... I find it necessary to remove images of software offered by the Company. His claim that he and he alone maintains copyright over all of the products and images can place members in legal jeopardy, as well as this forum. Of course saying it and proving it are two different things. I find it easier to just prevent crap.
