So Brendel is really taking models and objects from the community? This is something we already knew from way back on the BKPortal. I'm amazed there's ppl actually paying for it.
Sorry for the off-topic, maybe MP should reset this page again...

We have at least one object confirmed so far.
OK Dieter.... I don't know how you think you can steal work from another author and then sell his stuff in your commercial add-on, but the last one that did that too me paid dearly.

A brendel thread please!
btw: it just says that unauthorised selling and copying of the addon is forbidden by law. It doesn't say anything about the models included. I would like to see a comparisation between VOs original bridge and the one that is used in the addon...but please in a new thread

This is what google translate gave me for the last part of the Brendel "copyright" disclaimer.
A bunch of half truths. Sure there is copyright protection for some or all of the mod, but what he fails to mention is that he is the one violating copyright laws in multiple ways and is subject to both criminal and civil prosecution. What a piece of work this character is.

Can I break new rule and post Pegasus Bridge from new Brendel add-on. So everybody can see and judge for them self? BDW I sent that screen shoot to MP. sztylic: Let's not post the image here. Rule is for a reason. I did not get the image you mention. If you can send me the image or model, I will confirm if it is VOs. Email: majorpain.one@gmail.com
VO is still on vacation so he is not aware of this yet. I'm sure he and I will discuss this upon his return. I am obtaining a copy of said Add-On to verify reports of at least 35 objects and models taken from this community that were not to be used in any Commercial Product. Point: Just because you take someone's work for your own use or for commercial personal gain does not make it yours. What I find interesting is ' HIS' EULA on his site threatens legal action above and beyond NIVALs. But he has no issue using NIVALs Game Engine, objects, and code without regard to NIVALs EULA. No where does " HE" acknowledge NIVAL owns the copyright to Blitzkrieg. It is my impression that anything associated with NIVALs Blitzkrieg the Blitzkrieg (NIVAL) Copyright must be displayed in the splash screens, menus, and Box Art. What seems to be at stake here are these questions: Is it legal to use someones work and profit from it without paying compensation to the author? Is legal to use someone's work without permission and use it for personal gain? My opinion is both of these conditions fall under the Intellectual Copyright Laws. legal-dictionary.thefreedictionary.com/Intellectual+property+right+infringementWhile these actions violate International Laws, the Right of the Author must be reserved by the Author; meaning the Author must protect his rights by bring it to the attention of Protective Governing Councils. Some actions are Criminal and others are Civil. In some cases and conditions, they may be both. In the case of artwork, an Authors Copyright whether implied or construed... can last up to 70 years. Now works based or derived from another work may be considered a shared copyright if the 2nd author had License or agreement to promulgate the final work. That seems to cover NIVALs objects in this case where NIVALs original EULA provides a license to the players to 'change the game on their terms'. But it does not allow these inspired or final works to be sold for personal gain. For works that are not dependant on a third person's works or products, there is not requirement for original license and the works are considered original Intellectual Property of the author or artist. Generally, the unauthorized use by a third person for personal gain may be considered a criminal and civil offense with penalties of prison of 5 years for each offense and fines of $1,000,000 US for each offense. Civil restitution may reach up to $500,000 US per offense. The limits of penalties can vary between jurisdictions. Most of the European countries along with the US and Canada observe common law concerning this. So...

May I suggest that the members of this forum that create BK content like units, objects, skins, etc. systematically include an EULA (End-User Licence Agreement) to their work. Even if what is shared can be freely used it is still nice to know who is the author of the content so at least proper credit can be given to that person. Personally I do not believe that an EULA will prevent other people from unauthorized usage of content that was created by this community but it may make it a little more difficult for them to get away with it. Maybe some standard could be agreed that at least the author's name could be included in the XML file of an object.
